TERMS AND CONDITIONS

These terms and conditions (the "Terms and Conditions") govern the use of www.BLBFlooringSolutions.com.au (the "Site"). This Site is owned and operated by BLB Flooring Solutions. This Site is an ecommerce website.

By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.

Intellectual Property
All content published and made available on our Site is the property of BLB Flooring Solutions and the Site's creators. This includes, but is not limited to images, text, logos, documents, downloadable files and anything that contributes to the composition of our Site.

Acceptable Use
As a user of our Site, you agree to use our Site legally, not to use our Site for illegal purposes, and not to:

Violate the intellectual property rights of the Site owners or any third party to the Site.

commit any fraudulent acts.

If we believe you are using our Site illegally or in a manner that violates these Terms and Conditions, we reserve the right to limit, suspend or terminate your access to our Site. We also reserve the right to take any legal steps necessary to prevent you from accessing our Site.

Sale of Goods And Services
These Terms and Conditions govern the sale of goods and services available on our Site.

The following goods are available on our Site:

Flooring; and

Flooring accessories.

The following services are available on our Site:

Supply and Installation of Flooring; and

Delivery.

Book Free measure and Quote

The services will be paid for in full upon the completion of the service. Any bookings if cancelled will need to be canceled within atleast 48 hours before the booking was made and any bookings made will need to be made with atleast 48 hours notice before hand.

These Terms and Conditions apply to all the goods and services that are displayed on our Site at the time you access it. This includes all products listed as being out of stock. All information, descriptions, or images that we provide about our goods and services are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all goods and services we provide. You agree to purchase goods and services from our Site at your own risk.

We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.

When you provide us with your payment information, you authorise our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorise us to charge the amount due to this payment instrument.

If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.

Shipping and Delivery
When you purchase goods from our Site, the goods will be delivered through one of the following methods:

We offer delivery to anywhere in Australia($395)/Free Delivery for orders over $3999 all across Australia straight to your door, we deliver all products via freight companies/couriers and delivery will take between 1 - 14 business days but this is an estimate and shipping may take longer due to unforseen circumstances or if we are under increased demand for supply. You will need someone home on the day of delivery to sign off/collect the products from the courier. We may try to call you on the day of delivery to see if someone will be home for collection. In the case of if no one is home when your delivery gets there, it will be sent back to us or dropped at at the closest courier depot and we will not be liable if they are damaged or stolen and if we have to re-deliver them at a later date you will be charged delivery again for the return of products to your address. We will also let you know if there is ever any delays with delivery. No refunds available for delayed delivery due to unforseen circumstances.

Delivery will take place as soon as reasonably possible, depending on the delivery method selected. Delivery times may vary due to unforseen circumstances. Please note that delivery times do not include weekends and public holidays.

You may be required to pay delivery charges in addition to the price for the goods you purchase in certain cases.

You are required to provide us with a complete and accurate delivery address, including the name, phone number and email of the recipient incase we need to contact you about your order.. We are not liable for the delivery of your goods to the wrong address or wrong person as a result of you providing us with inaccurate or incomplete information.

Refunds
Refunds for Goods
Refund requests must be made within 14 days after receipt of your goods.

We accept refund requests for goods sold on our Site for any of the following reasons:

Good is broken;

Good does not match description; or

Good is the wrong size.

Refunds for Services
All services sold on our Site are non-refundable.

Returns
Returns can be made in person at the following location(s): Returns can be made by contacting us via phone ,email or our website and we can organise to inspect and pickup the returned goods from the address of delivery.

Guarantees
The following guarantees apply to our Site:

Product warranty 25-30 years depending on the product, each product specifies warranty .; and

Installation warranty 25 years.

Other Terms and Conditions for supply/Installation:

10% Wastage - We are not liable if you have not allowed for 10% for wastage and offcuts in your order and happen to fall short during installation, if you are unsure of how much wastage to allow you should give us a a call and we can assist you.

Subfloor levelness - Floating floors require a very level subfloor and we aren't able to inspect the levelness of the subfloor until the the existing floor covering is pulled up. If levelling compound is required to get a level surface before installation there will be an extra charge per bag for the levelling product needed and an extra charge of $100+GST per bag for labour and may need to be payed to us by bank transfer on the same day before installation can commence but in most cases we allow this in our quote that we give to you and will only apply if unforseen. Subfloor - Flooring Must be installed on a structural subfloor that is stable fixed and dry, changes in the subfloor may impact the floor e.g. floating floors or flooring susceptible to changes in moisture. Issues caused by changes to the subfloor are not warranted.

Cleaning - Our Installers will do a quick clean and sweep of the area including wastage, materials and rubbish but it is the customers responsibility to do a detailed clean afterwards.

Separation Joints/Trims - In some cases these will be required in doorways/hallways to allow for expansion/contraction of your flooring.

Cutting Doors - Doors may need to be trimmed after/during installation if this is the case then a extra fee will be added to your final invoice of $65 +GST per internal door and $100 +GST per external/entry door. Glass, Metal and Fire doors are not included and will need to be cut by someone who specifies in that trade.

Furniture/Home contents - It is the customers responsibility to pack away/move all furniture and impediments prior to the floor being installed unless already specified in the original quote or an additional charge of $80 or more per room will be added to the final invoice if applicable. it is the customers responsibility to organise the dishwasher/appliances to be moved/disconnected prior to installation of flooring or a fee of $80 or more will be added to the final invoice. We are not liable for appliances not fitting back due to height changes between benches and flooring. If we are required to move furniture we are not liable for damages if they may occur as we are not furniture removal specialists.

Electricity - Power points must be accessible for us to install your floor.

Variations - In Colour, grain , textures and surfaces occur in all types of floors within and across different batches especially for timber and bamboo floors, we do not recommend colour or texture matching different floors. variation in same batch flooring occurs in all types of flooring sometimes as well and is not a defect in the product.

Floor Direction - Floor direction will be determined on the day by the installer unless otherwise specified, we will ask you witch direction you would like it installed if you are home on the day of installation if not beforehand.

Refitting Skirting - When removing and refitting existing skirting boards there may sometimes be minor damages to walls/skirting boards especially on concrete or brick walls, patching nail holes/gap filling may be required and is the customers responsibility. (This is sometimes unavoidable and BLB Flooring Solutions is not responsible/liable for any damages.)

Accessories - Angles, Trims, Scotia/skirting must be specified by the customer, if a specific colour is not specified when ordered or on the day of installation we will choose ones to suit for you and the customer excepts this entirely.

 Acoustics - Any acoustic performance quoted is based on data from accredited testing, commissioned by our suppliers. As every installation site is unique, we do not guarantee acoustic performance and are not responsible for variations from performance data, we recommend on site testing if specific requirements exist.

Squeaking/Noises - Flooring can expand and contracts due to temperature and moisture change, sometimes you may experience some noises when walking on your flooring. This is more common with real timber/engineered and bamboo products that are installed with a floating system.

Cupping/Splitting - Natural materials including timber and bamboo may experience cupping and surface splitting based on moisture and seasonal changes and is not a major fault in the product.

Flooring Surface - Different types of flooring have different coatings/shines and may exhibit markings due to dirt, oil, grease or other substances (especially in high lighting areas.) unless the marks are fixed or present prior to installation and fail to be selected out by the installer, these are not a defect in the product.

Floating floors -  Floating floors should never have any lateral contact with any solid structure, this means no fixtures should be installed on top of or against the floors e.g. kitchens, cabinets, built in wardrobes, sliding shutters or door stoppers etc.

Warranty - Warranty on the product/installation commences the day the installation is completed by us, and is only effective once the total payment has been received. Products are not warranted if they are not installed by us as there is no way to tell if everything during the installation process was done properly and to standard.

Outstanding Payments - If payments on invoices are outstanding for more then 7 days after the job completion based on the scope of work outlined in the quote, you are liable to pay interest on the outstanding amount calculated at 12% per annum accruing daily and compounding monthly. if a formal letter of demand for debt collection has to be issued, a service charge will be issued. such fees will be payable by you to us immediately. 

By making a deposit/payment you agree to all of our terms and conditions/policies set on our website.

Consumer Protection Law

Where the Australian Consumer Law, Schedule 2 of the Competition and Consumer Act 2010, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.

Limitation of Liability
BLB Flooring Solutions and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.

Indemnity
Except where prohibited by law, by using this Site you indemnify and hold harmless BLB Flooring Solutions and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.

Applicable Law
These Terms and Conditions are governed by the laws of the State of New South Wales.

Severability
If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

Changes
These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site.
